Terms of Use
If we have a minor problem with the way you act on our site, we’ll
try to work it out; however, be advised that if you break any of our rules, we
can revoke your account and shut down your personal library. If you use our
site to break the law, we will report you to the authorities. By using
the ElectricStory.com site and affiliated sites, like our forums on Night Shade
and SFF.net, you agree to the following terms. Unless otherwise noted, the word
“we” in this document refers to ElectricStory.com, Inc.
General disclaimer
You agree that use of this site is at your sole risk. In creating
an account, you agree that you have freely supplied us with your personal
information and that the information pertains to you alone or a commercial
entity contractually affiliated with ElectricStory.com. You agree that apart
from meeting the assurances we make in this document, ElectricStory.com is
under no liability or obligation to you for any problem you encounter or injury
you incur as a result of your use of this site. In the event that, for any
reason, we cannot provide a service or product to you, you agree that our
monetary obligation to you will not exceed those sums you’ve actually paid to
us. You submit that you are at least 18 years of age or have the explicit
permission of your parent or guardian to create an account on this site and
purchase eBooks.
Use of all site content
Any material you view on our site is under copyright, even free
articles, stories, reader and staff reviews, and books, and especially
graphics, including book covers and logos. Unless we explicitly post
permission, you may not share any of this material. You may not use any artwork
for any purpose without the explicit permission of ElectricStory.com and,
often, the artist and/or author. If you violate these terms, you expose
yourself to severe, costly legal penalties.
Use of eBooks
Please, DO NOT share any eBooks you purchase here unless explicit
permission to do so is granted within the eBook itself. You may not
give printouts to any other people or share electronic copies. Do not make any
attempt to extract the text from the eBook or reverse-engineer the eBook. By
purchasing an eBook, you agree to be limited to the formats provided for it and
bound by any limitations that implies. You may back up your eBooks to disc or
other storage device for your personal use only.
Many parties have an interest in maintaining the commercial
viability of our eBooks: us, our authors, their publishers, their agents, and
so on. Any and all of these parties may take legal action against you if you
share an eBook or break its encryption! If you like what you read, please send
people to this site.
Personal eBook library
We provide your eBook library as a free service to you. We hope to
allow you indefinite, unrestricted access to your library, but we do not
guarantee it. If for any reason we must shut down your library and/or account,
we promise to provide you with one electronic copy of each book you have
purchased. Beyond that, we cannot guarantee you access to your eBooks. We
maintain records of eBook downloads; if you have downloaded an eBook according
to our records, we are under no further obligation to you for that title. You
agree to hold us completely harmless for any and all damages that arise from
your inability to access your personal library.
Affiliate ID
You may not transfer your affiliate id or login information to any
other party. You may not use your affiliate id in unsolicited e-mailings to
potential customers. You may include your affiliate id links in mailings to a
newsletter list as long as you gather e-mail addresses via a direct opt-in
process and provide unsubscribe information in your e-mail. Those distributing
an ElectricStory.com affiliate link through a spam e-mailing will have their
account suspended, and may incur legal action.
Events calendar
Your use of the events calendar is solely at your own risk. The
events calendar is a free service of ElectricStory.com and we bear no liability
whatsoever for its operation, including the reliability of its function or the
accuracy of its information. Our affiliates who use the calendar are solely
responsible for their posting of information.
PIDs, Encryption Keys
We hold a record of your Mobipocket PIDs and any other encryption
keys for accessing copy-protected eBooks as a free service. We do not guarantee
you access to encryption keys you’ve stored on our site. For each
copy-protected book you purchase from us, we promise to provide you with one
electronic copy of that book accessible via one key you provided to us. If you
lose the key or it becomes invalid, you agree that we are under no obligation
to provide you with a new copy of the eBook accessible via a different key.
Conduct in Forums
Our forums and those of affiliated sites are for the most part
self-policing. Forums are not meant for a general audience, and you agree that
by participating in the forums, you are an adult and not offended by mature
language. However, you may not use the forums to defame, harass, threaten, or
sexually proposition anyone. You may not post racial, religious, or ethnic
slurs. If you do, we can pursue a wide variety of remedies, including revoking
your account and contacting law enforcement.
Also, please do not use our forums or other posting areas to
advertise any product or service unless we are doing business with you. If you
do, we may revoke your account. For your protection, we strongly discourage you
from posting personal contact information in the forums, as anyone might obtain
it. We reserve the right to delete any forum posts for any reason.
Note that by using the forums you agree to hold us harmless of any
and all damages you thereby incur due to your sharing of information.
Reader reviews
Please do not post profane or provocative comments in your reader
reviews. If you don’t like a book, limit yourself to specific, reasoned
criticism. If you exceed our highly subjective standards of good taste, we’ll
warn you and delete your review. We reserve the right to delete any review for
any reason. Note that by posting a review on our site, you agree that
ElectricStory.com has unrestricted right to quote from it and repost it without
giving you any compensation.
Note that by posting a reader review you agree to hold us harmless of any and
all damages you thereby incur due to your sharing of information.
Account information
You agree to supply correct account information and update it upon
the request of ElectricStory.com. Otherwise, we may revoke your account and
shut down your personal library. If you create an account to impersonate
someone, we will revoke your account.
Illegal conduct
If you use your account to pursue any illegal activity, including
trafficking in drugs and stolen goods, either physical goods or digital, we will
report you to law enforcement.
Business Use
Unless you are explicitly, contractually affiliated with
ElectricStory.com, you may not use our site or affiliated sites to advertise
your business or otherwise pursue any business. You may also not create an
account with the name of a corporate entity unless we are doing business with
that entity and you represent it. If we find you are soliciting business via
our website, we will first give you a warning before pursuing any other action
(this policy subject to change without notice).
Harassing other members of ElectricStory.com
The forums on our site and affiliated sites are self-policing for the most
part. However, as stated previously, if you defame, threaten, or sexually
proposition someone, even jokingly, we may take action against you. Regardless
of the language you use, if you become a negative distraction for a large
number of members, we reserve the right to revoke your account or severely
limit your site access.
Privacy policy
We will not share or sell your account information without your
explicit permission. Your account details, including your name, address, and
e-mail address enter our databases encrypted by a high-level commercial
encryption algorithm so that in the unlikely event they are compromised or
stolen, your personal information will most likely be secure. All commerce
transactions conducted via our https secure links are encrypted to the highest
level available from PayPal,Inc., a trusted, industry-leading online payments processor. Payment is processed in real-time and your books are made available immediately.
All sales final
Due to the digital nature of our products, we generally cannot
offer refunds, with a few exceptions. We will refund your money if we determine
there was some clear mistake in processing your order, for instance, one that
results in your being charged twice for the same eBook or other digital
product. Note that each encrypted format of the same eBook or other digital
file, like Secure Mobipocket format, constitutes a separate product. If you buy
the wrong product, you may petition us for a refund or exchange, provided you
have not yet downloaded it. Downloading an eBook completes our transaction with
the distributor or publisher and makes us liable for its cost.
E-mail and mail communication
By creating an account on ElectricStory.com, you agree to receive
communication from us via e-mail or physical mailing. You agree to hold us
harmless for any inconvenience that arises to you as a result of these
communications. If you have indicated that you do not wish to receive our
newsletter, we will limit all our communication to questions about your
account. If you are receiving promotional mailings from us and wish them to
stop, go into My Profile under My Account and unclick the checkbox at the
bottom of your personal information that reads “Send me the ElectricStory
newsletter,” then click Submit. If you still receive mailings, please
write us at info@electricstory.com. We are a reputable business and do not
share or sell your personal information or send you unsolicited e-mail.
Links to this site
Feel free to link to this site at any level. We have no prohibition
against so-called “deep” linking to our site.
Arbitration
Any dispute arising between you and ElectricStory.com will be
settled pursuant to the laws of
Washington
State
and any legal action arising from such dispute will be conducted in
Seattle,
Washington.
Severability
These Terms of Use constitute a legal contract between you and
ElectricStory.com, Inc. If any provision of these terms of use is found to be
legally invalid, the other provisions shall maintain their full force and
effect.
Right to change or amend
ElectricStory.com reserves the right to change or amend these Terms
of Use at any time.
